These Terms & Conditions apply to purchases made from Somerset Bonsai Limited through our website. By placing an order with us, you agree to these terms.
Please read them carefully before placing an order. Nothing in these Terms & Conditions affects your statutory rights as a consumer.

2. Our Products
We make every reasonable effort to ensure that product descriptions, photographs, measurements and other information displayed on our website are accurate.
However, bonsai trees and plants are living products, and natural variations should be expected. The size, shape, foliage, colour and appearance of a plant can change naturally due to growth, pruning and seasonal changes.
Where a bonsai is sold as individually photographed, the photographs are intended to show the actual tree being offered for sale. Its appearance may nevertheless change naturally between photography and delivery.
For products from our generic ranges, photographs may be representative of the type, size and style of bonsai supplied rather than the exact individual tree you will receive.
3. Bonsai Pots
Our generic range bonsai may be supplied in our Standard Range pots. These are budget-friendly pots that allow us to offer attractive bonsai at affordable prices.
Our Standard Range pots are handmade and hand-glazed. As a result, minor variations and imperfections are a natural part of the manufacturing process. These can include slight variations in colour, glaze, finish or shape, small areas of imperfect or missing glaze, and a minor wobble.
We check our pots before dispatch to ensure that they are structurally sound and suitable for use.
Minor cosmetic imperfections that do not affect the structural integrity or intended use of a pot are not normally considered faults. This does not affect your statutory rights where a product is faulty, damaged or not as described.
4. Prices
All prices displayed on our website are shown in Pounds Sterling (GBP).
Any applicable taxes will be included or displayed as required. Delivery charges, where applicable, will be shown during checkout before you complete your purchase.
We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted by us.
If we discover an obvious pricing error after you place an order, we may contact you before accepting or fulfilling the order.
5. Placing an Order
When you place an order, you are making an offer to purchase the products in your basket.
You will receive an order confirmation after placing your order. Receipt of an order does not necessarily mean that we have accepted it.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- A product is unavailable or has unexpectedly become unsuitable for sale.
- There has been an obvious pricing or product-description error.
- We cannot obtain authorisation for payment.
- We are unable to deliver to the address supplied.
- We reasonably suspect fraudulent or unlawful activity.
If we cancel an order after payment has been taken, we will refund the appropriate amount to your original payment method.
6. Payment
Payment must be made using one of the payment methods available at checkout.
Your order may not be dispatched until payment has been successfully authorised or received.
Payment services may be provided by third-party payment processors, which may have their own terms and privacy policies.
7. Delivery
We will make reasonable efforts to dispatch and deliver orders within the estimated times shown on our website or provided during checkout.
Delivery dates and times are estimates unless we have expressly agreed otherwise. Occasionally, circumstances outside our reasonable control may cause delays.
Please ensure that the delivery information you provide is complete and accurate. We cannot accept responsibility for delivery problems caused by incorrect or incomplete information supplied by the customer, subject to your statutory rights.
Because bonsai are living plants, we may occasionally need to adjust dispatch arrangements where reasonably necessary to protect the health of the tree, for example during unsuitable weather conditions.
8. Checking Your Delivery
Please inspect your order as soon as reasonably possible after it arrives.
If your bonsai, pot or another product arrives damaged, faulty, significantly not as described, or you have received the wrong item, please contact us as soon as possible at info@somersetbonsai.com.
We may ask you to provide photographs of the product and packaging so that we can assess the problem and arrange an appropriate solution.
9. Care of Live Bonsai
Bonsai trees require appropriate care after delivery.
Customers are responsible for following the care guidance supplied with the bonsai or otherwise provided by Somerset Bonsai Limited.
The health and appearance of a living plant can be affected by factors outside our control after delivery, including watering, temperature, positioning, sunlight, frost, environmental conditions and general care.
This does not affect your rights if a bonsai was faulty, damaged or not as described when supplied.
10. Returns & Refunds
Returns and refunds are subject to our Refund & Returns Policy and your applicable statutory consumer rights.
Where an eligible non-faulty item is returned because you have changed your mind, ordered incorrectly or no longer require it, you will normally be responsible for the return postage.
Where legally applicable, standard outbound delivery charges will be refunded in accordance with your statutory cancellation rights. Additional amounts paid for upgraded, express or premium delivery may not be refundable.
If an item is faulty, damaged, not as described or supplied incorrectly, please contact us so we can arrange an appropriate solution.
11. Live Plants & Cancellation Rights
Bonsai trees and other live plants are perishable goods (if not cared for correctly). Statutory change-of-mind cancellation rights may not apply to goods that are liable to deteriorate or expire rapidly.
This does not affect your legal rights where a plant is faulty, damaged, not as described or otherwise does not conform to the contract.
Any non-perishable products purchased from us will be subject to applicable consumer cancellation rights and our Refund & Returns Policy.
12. Returns Condition
Where an item is eligible for return, it should be returned in its original packaging where reasonably possible and packaged securely to prevent damage during transit.
For eligible non-perishable goods, we may be entitled to make a deduction from a refund if the value of the product has been reduced because it has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning.
13. Product Availability
All products are subject to availability.
As many of our bonsai are individual living trees, stock can be limited and a particular tree may only be available once.
If a product becomes unavailable after you place an order, we will contact you and, where appropriate, offer a refund or another available option. We will not substitute a product without your agreement where doing so would materially change your order.
14. Promotions & Discount Codes
From time to time, Somerset Bonsai Limited may offer promotions, discounts or promotional codes.
Promotions may be subject to additional conditions, including expiry dates, minimum order values or exclusions.
Unless otherwise stated, promotional codes cannot be exchanged for cash or applied retrospectively to orders that have already been completed.
15. Website Information
We take reasonable care to ensure information on our website is accurate and up to date.
Occasionally, errors may occur in product descriptions, availability, measurements, prices or other website content. We reserve the right to correct errors when identified.
16. Intellectual Property
Unless otherwise stated, the content of the Somerset Bonsai Limited website, including our original photographs, text, graphics, branding and other materials, belongs to Somerset Bonsai Limited or is used with appropriate permission.
Such content must not be copied, reproduced, distributed or used commercially without permission, except where permitted by law.
17. Our Responsibility to You
We are responsible for losses that are a foreseeable result of our breach of these Terms & Conditions or our failure to use reasonable care and skill.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Products sold through our consumer website are intended primarily for personal and domestic use. We are not responsible for business losses where the law permits such an exclusion.
18. Privacy
We take the protection of personal information seriously.
Information provided to Somerset Bonsai Limited will be handled in accordance with our Privacy Policy and applicable UK data protection legislation.
19. Changes to These Terms
We may update these Terms & Conditions from time to time, for example to reflect changes to our website, business practices or legal requirements.
The terms applying to your purchase will normally be those in effect when your order was placed.
20. Governing Law
These Terms & Conditions are governed by the laws applicable in England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections and rights applicable where you live.
